Subscription Plans and Credits ### 4.1 Subscription Tiers We offer multiple subscription tiers: - **Free Tier**: 50 credits upon signup, 1 social account per platform, 3 custom templates - **Pro Tier**: 500 credits per month, 3 social accounts per platform, 20 custom templates - **Power Tier**: 1,000 credits per month, enhanced features - **Max Tier**: 3,000 credits per month, unlimited templates, priority support ### 4.2 Credit System - Credits are used to access AI-powered features including content generation, image creation, video processing, and lead hunting - Credit costs vary by feature (e.g., 2-5 credits for slider carousels, 5 credits for AI images, 60 credits for Submagic videos) - Credits are non-refundable and non-transferable - Unused credits may expire according to your subscription terms - We reserve the right to adjust credit pricing with reasonable notice ### 4.3 Payment and Billing - Subscription fees are billed in advance on a monthly basis - All fees are exclusive of applicable taxes - You authorize us to charge your payment method for all fees - Failed payments may result in suspension or termination of your Account - You are responsible for providing current payment information ### 4.4 Refunds and Cancellations - Subscription fees are generally non-refundable - You may cancel your subscription at any time - Cancellation takes effect at the end of your current billing period - No refunds will be provided for unused credits or partial subscription periods - We may offer refunds at our sole discretion in exceptional circumstances --- ## 5. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and improving the Service. ### 6.2 Generated Content Content generated by our AI systems based on your inputs ("Generated Content") is owned by you, subject to these Terms. We do not guarantee: - Accuracy, completeness, or reliability of AI-generated content - That AI-generated content will be free from errors or suitable for your purposes - That AI-generated content will not infringe third-party rights - That AI-generated images will be unique or original ### 7.2 Your Responsibility You are solely responsible for: - Reviewing and editing AI-generated content before use - Ensuring content complies with applicable laws and platform policies - Verifying that content does not infringe third-party intellectual property rights - Any consequences of posting or distributing AI-generated content ### 7.3 Content Moderation We reserve the right to: - Review, monitor, or remove any content at our discretion - Suspend or terminate accounts that violate these Terms - Report illegal content to appropriate authorities - Implement automated content filtering systems --- ## 8. Lead Hunter and Reddit Integration ### 8.1 Lead Hunter Service Our Lead Hunter feature helps you discover potential customers on Reddit. You agree to: - Use Lead Hunter only for legitimate business purposes - Comply with Reddit's Terms of Service and User Agreement - Not engage in spam, harassment, or deceptive practices - Respect community guidelines of each subreddit - Not use automated tools to mass-post replies ### 8.2 Reddit Data - Lead data is sourced from publicly available Reddit posts - We do not guarantee accuracy or completeness of lead data - Lead quality scores are AI-generated estimates, not guarantees - You are responsible for verifying lead information - We are not responsible for changes to Reddit's API or policies --- ## 9. Video and Image Processing ### 9.1 Uploaded Media When you upload videos, images, or audio files: - You represent that you own or have rights to the media - You grant us permission to process the media using our AI systems - Processed media is stored securely in our systems - You may delete your media at any time - We may retain backups for a reasonable period ### 9.2 Third-Party Processing We use third-party services for media processing: - **Submagic**: Auto-captions and video enhancements - **Fal.ai**: UGC video creation - **ElevenLabs**: Text-to-speech voice generation - **Google Gemini**: Image generation By using these features, you agree to comply with the respective third-party terms of service. ### 9.3 Processing Limitations - Maximum video duration: 60 seconds (Submagic), 10 seconds (UGC) - Maximum file sizes: 500MB (Submagic), 100MB (video editor), 10MB (images) - Supported formats: MP4, MOV, AVI, WebM (video); JPG, PNG, WebP (images) - Processing times vary and are not guaranteed --- ## 10. Data Privacy and Security ### 10.1 Data Collection We collect and process personal data as described in our Privacy Policy, including: - Account information (email, name, avatar) - Usage data (features used, credits consumed) - Content data (generated content, templates, scheduled posts) - Social media tokens (encrypted OAuth credentials) - Analytics data (page views, feature usage) ### 10.2 Data Security We implement industry-standard security measures: - Row-Level Security (RLS) on all database tables - Encrypted storage of OAuth tokens and sensitive data - HTTPS encryption for all data transmission - Regular security audits and updates - Secure authentication via Supabase Auth ### 10.3 Data Retention - Active account data is retained while your account is active - Deleted content is removed from active systems within 30 days - Backups may retain data for up to 90 days - You may request data deletion by contacting us --- ## 11. Termination ### 12.1 Termination by You You may terminate your Account at any time by: - Contacting us at TinyGiantTech@gmail.com - Using account deletion features in the Service - Canceling your subscription ### 12.2 Termination by Us We may suspend or terminate your Account immediately if: - You violate these Terms or our policies - You engage in fraudulent or illegal activities - Your account is used for abuse or spam - We are required to do so by law - We discontinue the Service ### 12.3 Effect of Termination Upon termination: - Your access to the Service will cease immediately - Unused credits will be forfeited - Your content may be deleted after a reasonable period - Provisions that should survive termination will remain in effect - No refunds will be provided for prepaid fees ### 12.4 Account Deletion Process You can request deletion of your account through Settings → Account. **30-Day Grace Period:** - When you request deletion, your account is scheduled for deletion in 30 days - During this period, your account remains active and you can cancel the request - After 30 days, deletion is automatic and irreversible **Data Deleted After 30 Days:** The following data will be permanently deleted: - All connected social media accounts (Instagram, TikTok, YouTube, LinkedIn, Pinterest, Reddit, Twitter) - All OAuth access tokens and refresh tokens - All posting history and analytics - All scheduled posts in the queue - All video metadata (names, tags, captions) - All video processing jobs - All storage files (videos, both raw and processed) - Your user account and authentication data **Data Retained (For Compliance):** - Audit logs of deletion request (date/time only, no personal data) - Billing records (if required by law, typically 7 years) - Anonymized, aggregated analytics **Cancellation:** You can cancel the deletion request anytime during the 30-day grace period by: - Going to Settings → Account and clicking "Cancel Deletion Request" - Emailing TinyGiantTech@gmail.com with "Cancel Account Deletion" **Important:** - This action cannot be undone after 30 days - Download your data before requesting deletion - Your subscription will be cancelled automatically - No refunds for unused subscription time or credits --- ## 13. Disclaimers and Limitations of Liability ### 13.1 Service Availability THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee: - Uninterrupted or error-free operation - That defects will be corrected - That the Service is free from viruses or harmful components - Specific uptime or availability targets ### 13.2 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR: - INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES - LOSS OF PROFITS, REVENUE, DATA, OR USE - BUSINESS INTERRUPTION OR LOSS OF GOODWILL - DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE - DAMAGES ARISING FROM THIRD-PARTY CONTENT OR CONDUCT OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER. ### 13.3 Third-Party Services We are not responsible for: - Actions or policies of social media platforms - Third-party AI service availability or accuracy - Changes to third-party APIs or terms - Content posted to third-party platforms - Third-party data breaches or security incidents --- ## 14. Indemnification You agree to indemnify, defend, and hold harmless SocialGummy, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Content you create, upload, or distribute - Your violation of applicable laws or regulations --- ## 15. Dispute Resolution ### 15.1 Governing Law These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. ### 15.2 Jurisdiction You agree that any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. ### 15.3 Informal Resolution Before filing a claim, you agree to contact us at TinyGiantTech@gmail.com to attempt to resolve the dispute informally.
